editing article does not load cke, uses html editor only

this may be duplicate, I did not have chance to search and wanted to mention this before I forget.
when creating new article the rte/html toggle option is there.
so create article in normal mode (cke) and save it.
then when you go to edit its in html mode and no option to toggle, that button is actually missing at this point.
this MAY have been mentioned by bfarber before re: the ccs-board editor issues, if duplicate I am sorry.

if I disable allow html on backend the button is there when editing.
almost positive bfarber has spoken on this.
There was a bug where when *adding* a new article the editor was in RTE mode (even though it should be disabled), but that has since been fixed.
I remembered you had spoken on this but could not find specifics.
the biggest issue with this rte/html disconnect is in the forum posts created by the article which, iirc, was the topic you had been specifically speaking of in the past.
